Terms and Conditions

 

These terms and conditions apply to a Hirer who order’s online, in person, by email or over the telephone. By paying the part or all of the hire charge you the Hirer and the Payment Card Holder are agreeing to these terms and conditions and authorise Tina Nisson Design to debit the payment card provided to cover any charges and subsequent financial losses that apply. As your order is bespoke and we select items created as a bespoke package for you, you are not covered by the distance selling regulations.

 

Goods will not be released for hire until full payment has cleared.

 

The standard rental period is between 1 to 3 days, if you require the items for longer this is counted as more than one rental period and may not normally exceed 30 days. Unauthorised late return will result in 50% charge of original hire costs per day on a day by day basis. Late return is defined as exceeding 96 hours from the time of receipt of goods by the hirer or their representative at the nominated delivery address until the time of return to the unit of Tina Nisson Design.

 

The minimum charge for any rental varies depending on the location the delivery/collection is required.

 

Time Slots for Deliveries and Collections

If you have a particular time when we must deliver or collect this will be noted and we will have the best of intentions to adhere to it. We therefore ask that you or your representative is available to meet our delivery or collection. You agree to be CHARGED if Tina Nisson Design or their representatives spend more than 10 minutes attempting to make delivery. You agree that items are not counted as returned until they are at our unit and have been checked by a member of our staff.

 

We understand that some delivery and collection time slots may be very tight, however factors beyond our control may affect the route such as Police Incidents, Road Closures, Traffic issues, etc that mean we cannot make the requested time slot. Tina Nisson design will not be held liable for any charges you may incur in relation to our delivery or collection.

 

Reduction of Order Value

Once payment is made, you have secured all of the items on your quotation. It is not possible to reduce the order value or items required prior to the event as the items could have been made available for other customers to hire. If you wish to add more items over and above your original order we will check the availability but cannot guarantee they will be available.

 

Delivery and Collection

Tina Nisson Design will arrange all delivery and collection of all items to an address of your choice; the cost of this service is usually £30.00 for London addresses but will be more outside London based on the distance by road.

The Hirer is welcome to collect and return items to our unit Monday to Friday 8am to 5.30pm; We cannot accept customer returns at our unit on a Saturday, Sunday or on a Bank Holiday unless special arrangements are made.

Our standard delivery or collection time on site is 10 minutes, if our driver and vehicle are required to wait for more than 10 minutes we charge £10 per 10 minutes.

 

Cancellation Policy

When a Hirer places an order, Tina Nisson Design ask for full payment of the Rental fee to secure the items. If the Hirer cancels the order prior to the delivery day for whatever reason the full amount is still due not including delivery charges. If the Hirer cancels the order on the delivery day for whatever reason the full amount is still due including delivery charges. All cancellations must be confirmed by email to be counted as authorised. No items are considered confirmed until the full amount has been paid.

 

If the Hirer wishes to discuss an order, please call us on 07876 473 898 and email us at tina@tinanissondesign.co.uk as soon as possible. No variations to order or delivery or collection arrangements can be taken by delivery drivers.

 

Item Substitution

We hire some items that are one off or are of a unique nature. If you have hired one of these items and they are damaged or lost, we will contact you and offer a similar item if available. If you are not satisfied with the substitution we will credit you for the hire cost of the item. No other compensation will be payable by Tina Nisson Design.

 

Use, Care and Return

Tina Nisson Design agrees to rent items to the Hirer for the period stated in the rental agreement. The rented items shall at all times remain the property of Tina Nisson Design. The Hirer must insure the rented items as the Hirer is liable and responsible for the items during the rental period that commences from the time the items are collected by the Hirer or delivered to the Hirer by a representative of Tina Nisson Design. The hire period finishes when the goods are returned by the Hirer and checked by Tina Nisson Design at their unit. For the avoidance of doubt, items are not counted as returned until Tina Nisson Design have checked them for damage at their unit. In this case a delivery signature does not count as the items being returned and checked to Tina Nisson Design and you accept charges may still apply.

 

When the items are delivered to the Hirer, the Hirer shall inspect the items. In the event of any missing or damaged items, the Hirer shall contact us on 07876 473 898 immediately. If the Hirer fails to do this, the items will be deemed to have been delivered or collected from our unit in a clean and undamaged condition. If no one is available to check the items, again the items will be deemed to have been delivered in a clean and undamaged condition.

When Tina Nisson Design collects the rented goods, they should be properly packed in the boxes they were delivered in. Please use the packaging supplied.All items hired from Tina Nisson Design are to be returned cleanedand in the same conditionas received.

 

Do not deface or remove any labels from and/or interfere with the pieces, their working mechanisms or any other parts of them.

Do not use adhesives or sticky tape of any sort.

Take reasonable care of the Equipment & keep them properly maintained & only use them for their proper purpose in the correct manner.

Please return all hire in the original boxes and packaging it was received in.

 

If the Equipment is returned in damaged, unclean and/or defective state you shall be liable to pay us for the cost of any repairand/or cleaning required to return the Equipment to a condition fit for re-hire. Please ensure they are suitable wrapped on return.

Damage in transit due to poor packing will be chargeable to client.

 

Damage or loss

The Hirer will be informed if there is any damage, missing or substituted items, including packaging and boxes. The replacement cost for missing and or damaged items, crates and packaging is payable by the Hirer. The retail price of each item will be deducted from the Hirers card or the card provided for payment.  Any replacement costs due to damage will be charged at 4 times the hire price. You the Hirer and the card owner are liable for any charges and give Tina Nisson Design permission to collect any monies owed from the card provided. The Hirer and the card owner agree to these terms and conditions when the order is placed.

 

Interest at the rate of 4% a year above the base lending rate of National Westminster Bank Plc will be added to any monies owed if the invoice is not paid within 30 days.

 

On demand the hirer will pay Tina Nisson Design’s costs, including reasonable legal fees where permitted by law, incurred in collecting payments due from Hirer under the Agreement. Value added tax and all other taxes and levies on any of the charges listed above, as appropriate. The Hirer is responsible for all charges, even if they have asked someone else to be responsible for them e.g. a caterer, hotel, party planner or venue. The Hirer and card owner agree to pay reasonable fees owed to Tina Nisson Design including charges due as a result of financial loss.

 

Liability

Tina Nisson Design’s total Liability to the Hirer under and/or arising in relation to any agreement shall not exceed 2 times the amount of the Rental and charges for Services (if any) under that agreement or the sum of £500 whichever is the higher. The Hirer will indemnify Tina Nisson Design against any claims made for damage to person or property.

Tina Nisson Design shall have no Liability to the Hirer if, without just cause, any monies due in respect of the rented items have not been paid in full by the due date for payment.

Nothing in this Contract shall exclude or limit the Liability of the Supplier for death or personal injury due to the Supplier’s negligence nor exclude or limit any other type of Liability which it is not permitted to exclude or limit as a matter of law.

Any defective rented goods must be returned to the Supplier for inspection if requested by the Supplier before the Supplier will have any Liability for defective Hired Items.

Governing law

The Agreement is governed by the laws of England. Any dispute may be submitted to the non-exclusive jurisdiction of the English courts. If any provision of this Agreement is or becomes invalid or unenforceable the remaining provisions shall not be affected
